Special Provisions & Buyer’s Note
- All the toys in this auction are used, many are missing decals, exhaust stacks, etc. Some, but not all, defects and any repairs that are not visible from the photos are included in the descriptions. Minor defects such as paint chips from handling and use should be expected on all the items.
- The items in boxes have been out of the boxes, and were returned to the boxes. Collectors looking for pristine pieces need to be aware when bidding these items are used.
- Persons attending sale previews and during pickup and removal times assume all risks of damage or loss to person and property and specifically release and indemnify the auctioneer and seller from liability therefore.
TERMS OF SALE & ONLINE BIDDING TERMS
Read Before Bidding.
- Registration: To bid on the personal property you will need to register and receive a bidder number at ChelfAuction.com. A valid credit card is required to register to bid. The Identity of all bidders will be verified, no charges will apply. By registering to bid, the bidder acknowledges he/she has read and understand the specific terms & provisions of sale, and aggress to be bound by such.

Only the Successful Bidder will be Notified by the Auction Company
- Payment Terms: Payment methods, cash or check payable at pickup. 6 % Kentucky sales tax will apply unless Buyer is tax exempt. Successful bidders will be required to provide a copy of their tax exemption certificate at the time of payment, or pay sales tax.
- Condition: All items are selling “AS-IS, WHERE-IS” & with all faults. Buyer acknowledges the property was available for inspection during the Bidding Period, and was permitted to conduct an independent inspection of the property before bidding. Buyer waives all post-sale inspection rights and acknowledges and agrees that neither the Seller nor Auctioneer is required or will make any adjustments or repairs of any kind whatsoever to the property, or any adjustments in the amount buyer paid for an item.
- Inspection & Descriptions: The property is available for inspection any time during the Bidding Period, and is strongly encouraged. Bidders should verify and satisfy themselves as to the condition, quality, and description of the property before bidding. Descriptions provided are believed accurate but not warranted, and are for advertising purposes only. Any measurements provided are approximate. There are no expressed or implied warranties made by the Seller or Seller’s Agent pertaining to the sale of this property. Call the Auctioneers to schedule an appointment to personally inspect the property.
- Online Bidding: By placing a bid on the property, all Bidders signifies that they have examined the property to their satisfaction, or have chosen not to personally examine the property they are bidding on. Failure to inspect or to become fully informed about the Property being offered shall not be grounds for refusal to pay the amount due for the property.
- Auction Start Date & Close Dates: The auction will begin on Wednesday November 15, 8:00 am. The auction will begin to close on Thursday November 30, 5:00 pm.
- Auto-Extend: The Bidding will start to close 11/30/023 at 5:00 pm. The bidding period will Auto-Extend for 2 minutes after the latest bid.
- Preview Date, Time & Location: - Monday November 27 , 2023 from 2:00pm until 4:00pm. 2555 Big Springs Rd. Scottsville, KY 42164
- Item Pickup Date, Time & Location: Pickup will be on Friday December 1, 2023 from 10:00 am until 5:00pm. Proper identification required. Location: 2555 Big Springs Rd. Scottsville, KY 42164 Items not claimed by 5:00pm will be considered abandoned. Buyer will be charged the full amount for items or property not picked up by the designated date and time, and forfeit His/her right and claim to the property. NOTICE: Auctioneers will not hold items for pick up beyond the stated times. Everything must be picked up by 5:00pm on 12/1/2023.
- System failures: The Auctioneer reserves the right to continue the bidding, extend the bidding, cancel and/or reopen the bidding in the event of system failures and technical difficulties related to the server, software, or any other online bidding related technologies. The Selling Agent and software company shall not be held responsible for missed bids or failure of the software to function correctly for any reason.
- Change of Notice: All aspects of the online bidding are subject to change without notice. The auctioneer reserves the right to make changes of any kind, and take any necessary action deemed necessary to affect the fair conduct of this sale for the protection of buyers, sellers or other parties’ interest. The Auctioneers retain the right to govern goods and services sold to clients and maintain the integrity of the auction company. Auctioneers reserve the right to reject any bid and/or bidder at our sole discretion.
- Local pick up only. Buyer is responsible for shipping services. There is no shipping or packing serves provided by the auctioneers
